I had to learn my rights the hard way…read this, study it, memorize it, this is insanely valuable information.
I’m not sure about the USA, but I know some extra stuff about UK law cause I study it (Though only at A level, not degree level!). OK, so, if you are being searched by an officer, they have to tell you: the grounds of the search, the offence they think you have/are/will commit, identify themselves and their station (Usually an officers ID number for reference), they have to read you your rights in relation to the search (different to arrests), state the act under which they are arresting you, and say clearly that you are being detained for the purposes of a search. Breaking any of these can start a viable civil law case, though if it isn’t significant, you may be advised not to. Also, don’t ever volunteer for a search. Unless the officer tells you they need to search you and why, don’t volunteer. The reason for this, is that you effectively give up all of your rights in relation to searches when you volunteer (Again, this is for the UK, so I’m not sure about elsewhere). If the officer tells you they are searching you under the CJPO then they DON’T NEED A REASON. This is put in place for big events when it is likely that people might cause trouble (’in anticipation of violence’), and lasts for 24 hours, and isn’t very common, but just know that if they say that’s the act, then they don’t need to have reasonable suspicion.
In relation to arrests, the reasons they would arrest you must be due to an unknown identity (Or one that sounds fake and can’t be verified), to protect a child or vulnerable person, to prevent injury to yourself or others, to prevent absconding, or to prevent unlawful highway obstruction. The officer should read your rights. At the station, you should be taken to a custody officer, who will monitor your detention and keep custody records. For summary (lesser) offences, you should be detained for 24 hours only. Speak to a solicitor when you can. You have the right to read the codes of practise when there, and if you are blind, then braille editions should be available. You should get two light and one main meal every day you are detained for (Just one for summary offences).
